1. The Promoter

1.1 The promoter is: THE DREAM COMPANIES CORPORATION LIMITED Registered in England & Wales under company number 12471120 whose registered office address is at 63/66 Suit 23, Fifth Floor, Hatton Garden, London, United Kingdom, EC1N 8LE and trading as “Dream Watch Company”.

2. The competition

2.1 The title of the competitions covered by these terms and conditions is Win your Dream Watch. Each competition itself may have its own specific title.

2.2 The Promoter may offer different prize competitions for different prizes (luxury watches) and the mechanic of the competitions is as follows:

(a) Entrants will be able to select (on the Promoter’s website) which individual watch competition they wish to enter.

(b) Each Watch competition will have its own specified prize watch, its own price per entry, its own overall number of entries and other details. Some of these will depend on the value of the prize Watch.

(c) Entrants will also be able to select the number of entries they require, up to a maximum of 50 per entrant.

(d) Once selected an Entrant will be required to complete a task and / or answer questions; and they will then proceed to pay for their entry/ies.

(e) Please note that Entrants’ entry payments will not be refunded in the event that their answers are incorrect.

(f) If all or the specified minimum number of entries are not sold / made the competition closing date may be extended by 2 weeks (14 days). The competition closing date may be extended up to a maximum of 2 times (28 days) to allow for the required number of entries to be sold. If after the allotted extensions the minimum number or entries are not reached the Entrants’ entries will be cancelled, the prize competition cancelled and the Entrants’ entry fee payment refunded in full by within 14 days of cancellation.

(g) Once all (or the specified minimum number) of entries have been received the winner will be the Entrant with the correct answer/s and/ or successfully completed tasks, if required. If there is more than one such Entrant, a winner will be selected (from those participants with the correct answer/s) at random within the competition time periods note below by an {independent third party selection mechanism}.

3. How to enter

3.1 For each specific competition the Opening Date and the Closing Date will be specified on the Promoter’s website (www.dreamwatchcompany.com) or as part of the competition entry process. Unless stated otherwise as part of the competition entry process each competition will run for 30 calendar days from the “Opening Date” and that will be the “Closing Date”.

3.2 All competition entries must be received by the Promoter through its website (www.dreamwatchcompany.com) (the “Website”) using the on-line entry process for the relevant competition by no later than 11.59 pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified and entry fees for late entries will be refunded/ not accepted.

3.3 To enter the competition:

(a) enter the competition online by submitting the ONLINE ENTRY FORM provided on the Promoter’s website at www.dreamwatchcompany.com by the Closing Date, together with your payment and contact details.

By completing the on-line ENRTY FORM you will also be confirming and agreeing that:
(i) you are over 18 years of age.
(ii) you consent to the Promoter’s Privacy Policy, and to be bound by these terms and conditions.
(iii) That you are legally eligible in your country of residence to enter.
(iv) The promoter using your name and city/country to announce the winner should you be successful.

3.4 An ENTRY FEE PAYMENT is required for each competition and the ENTRY FEE for each competition will be specified on the Promoter’s website for each relevant competition. There is no charge to register for use of the Website.

3.5 The Promoter will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition. Postal entries are not accepted.

3.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.9 The competition entries will be judged {to ascertain whether the Entrant’s answer/s are correct and / or tasks successfully completed by the Promoter based on the answer given or task completed on entry the required answer/s and or tasks for each prize competition must be 100% correct in order to qualify. In the event that more than one Entrant qualifies, the decision of the Promoter {with the panel of judges (acting reasonably)} will be final. In the event that no Entrants qualify there will be no winner and the Promoter shall retain the prize.

3.10 The Promoter will send the full names of the adjudicator / judges to anyone who writes (or emails) to the Promoter within one month after the Closing Date of the competition requesting details of the judges and who encloses a self-addressed envelope to the address or email address of the promoter as follows:

3.11 SELECTION OF WINNER:

(a) The selection of the Winner from the Entrants who have qualified by submitting the correct answers or otherwise passing the required test/s (the “Qualifying Entrants”)] will be selected by an independent 3rd party computer system (the “Selector”; details of which, if not provided herein , will be set out in the Entry Form/ Entry process of each competition.

(b) The Promoter submits to the Selector the names and/ or account number only of all Qualifying Entrants.

(c) The Selector’s shall select the Winner.

4. Eligibility

4.1 The competition takes place in the United Kingdom (UK) and is subject to the Laws of England & Wales. The competition is only open to persons aged 18 years or over, and the excluding the following persons who are disqualified from entering:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

(d) residents of countries where prize competitions are not permitted or where the entrant is otherwise prohibited from entering.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize OR any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3 The Promoter will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in excess of the stated maximum number of entries per person.

(c) illegible, have been altered, reconstructed, forged or tampered with; or

(d) incomplete.

4.4 There is a limit of 50 entries {or such other number specified for each competition} to the competition per person/ Entrant. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4.6 Competition entries cannot be cancelled retracted, returned once submitted.

5. The prize

5.1 The prizes are described on the Website under the relevant Competition sub-title are available to be won.

5.2 The Watches may be pre-owned or pre-ordered and may not all therefore still have the benefit of the full duration of the manufacturer’s warranty. Unless stated otherwise for the competition they will otherwise all be as new. The Promoter provides no additional warranty to the manufacturer’s warranty and any warranty that it is required by law to provide.

5.3 Prizes may be claimed between 14 and 28 days after the Promoter has notified the Winner by email and received proof of identification and address to include date of birth.

5.4 The Promoter will arrange delivery of the prize to the Winner within 14 days of it being validly claimed {and the Winner being validly identified, if required at the Winner’s address provided at checkout.

5.5 The prize does not include insurance, tax or the covering of other personal expenses of the Winner. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the Winner(s).

5.6 The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

5.7 The prize is supplied by the Promoter directly and not by the Watch Manufacturer. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.

5.8 The prize is not negotiable or transferable.

5.9 In order to claim the prize you must:

(a) Produce the card used to make the on-line payment that you made when entering and

(b) Produce your Photo ID and proof of address and

(c) such proof of age and identity as the Promoter may reasonably require to verify your identity by14 days after claiming the prize.

6. Winners

6.1 The decision of the third party selector {detailed above} of the Winner and the decision of the Promoter are final and no correspondence or discussion will be entered into.

6.2 The Promoter will contact the Winner personally as soon as practicable (no later than 14 days) after the Winner has been decided (and such date will be the Announcement Date), using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners and, if applicable, their winning entries to the companies Instagram account and / or Website (www.dreamwatchcompany.com) on the Announcement Date.

6.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter info@dreamwatchcompany.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7. Claiming the prize

7.1 Please allow 14 days after the Announcement Date and any verification of the Winner’s identification in accordance with clause 5.7 above for delivery of the prize.

7.2 The prize may not be claimed by a third party on your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 28 of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of competition entries and intellectual property rights

9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

9.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9.3 You agree that the Promoter may, but is not required to, make your entry available on its Website http://www.dreamwatchcompany.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry [and any accompanying materials], to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

10. Data protection and publicity

10.1 The Promoter will only process your personal information as set out in the PRIVACY POLICY. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.

11. General

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

12. Governing Law

12.1 These terms and conditions are governed by the Laws of England & Wales.

12.2 The courts of England & Wales shall have exclusive jurisdiction over any dispute in relation to these terms and conditions.
